Excess Clause

In the event of any damage, loss or theft to the rental vehicle by the Renter, regardless of whether Renter is at fault, the Renter is liable to pay the full cost of the damage or market value of the vehicle (in the event of theft), including loss of use as determined by Avis Malaysia. Avis Malaysia shall also be entitled to charge the renter a maximum excess fee as per the vehicle group each time the vehicle is damaged or stolen, regardless whether Renter is at fault.

However, with the coverage of CDW, SCDW, SCDW+ & TP, the Renter is entitled to pay a reduced excess fee depending on the category of the damaged or stolen vehicle.

Collision Damage Waiver (CDW), Super Collision Damage Waiver (SCDW) & Super Collision Damage Waiver Plus (SCDW+):

Either one of the CDW, SCDW or SCDW+ options are compulsory to be included in the rental rates. In the event that the rented Avis vehicle sustains damage, the renter is liable to pay reduced excess (see below):

Theft Protection (TP):

TP is compulsory to be included in the rental rates. In the event of vehicle theft, the Renter will be liable for the market value of the vehicle. However, this amount could be reduced to the excess amount as per SCDW due to the rates are inclusive of TP.

Personal Accident Insurance (PAI):

The coverage protects the principle driver and four (4) or six (6) passengers in a vehicle (category) for a total amount of RM100,000.00 against bodily injuries and disability. This coverage is extended to the principle Renter throughout the entire duration of the rental. PAI is excluded in the rental rate. The Renter has an option to purchase it at RM6 per day or RM180 per month.

Notwithstanding to the above CDW, SCDW, SCDW+, TP and PAI shall not cover the following events:

> where a police report is not lodged within 24 hours from the time of accident/incident to the Vehicle;

> the Renter is in breach of the Terms and Conditions of the Rental Agreement;

> Loss items, accessories, and any damage claims arise out of drunkenness and/or drug intoxication of the driver.

> where the loss, damage or theft is caused intentionally, or due to gross negligence of the Renter or an authorised driver.

 a. Renter agrees in case of accident during the term of the rental to:

       i.   Obtain the name, ID and addresses of the parties involved and witnesses.

       ii.  Not abandoning the said vehicle without adequate provisions for safeguarding and securing the vehicle.

       iii. Give a detailed report including diagram, even in the case of slight damage within 24 hours and by telephone to the nearest Avis Station and complete the Avis accident report form. 

       iv. Make it mandatory to make a police report of the incident within 24 hours.

b. The said vehicle is prohibited to be operated:

     i.  In motor sports events, including any forms of racing ativities, for teaching someone to drive, and any sort of road-testing (out of normal vehicle usage).

    ii.  In any sort of off-road conditions.

    iii. By any person under the influence of alcohol or drugs.

    iv. Driven into Singapore, Thailand, Indonesia, Brunei, Langkawi, Tioman, Redang, Pangkor, etc.

c. Interior Cleaning:

The Renter is liable for all interior upholstery cleaning if vehicle is returned with dirtied interiors. The Renter is also liable for all interior and exterior damages and / or defects caused which do not fall within normal wear and tear of the vehicle.

d. Interior & Exterior Damages:

The Renter is also liable for all interior and exterior damages and/or defects caused including damages to instruments, knobs and fittings, which do not fall within normal wear and tear of the vehicle. 

e. Lost or Broken of Parts or Accessories:  

The Renter is liable for all missing, stolen or broken parts during the rental period or upon vehicle return unless the rental vehicle is damaged as a result of an accident. Example of supplementary parts or accessories include but not limited to Baby Seat, GPS Navigator, Spare Tires, Rims, Tools & Jacks, Lamp, Audio Set, Gear Lock, Lighter, Wiper, Switch & Control Buttons, Mats, Rear View Mirror & Side View Mirror, Sun Visor, Head Rest and etc. Lost or damage of the above supplementary parts or accessories will be the responsibility of the Renter.

f. Loss of Vehicle Keys/ Duplicate of Vehicle Keys:

The Renter is liable for all replacement cost of Vehicle Keys which includes a new set of keys and its security system and/or whatever items pertaining to the loss of vehicle keys and vehicle security system.

g. Loss of Belongings:

Avis Malaysia is not liable for any missing, broken, stolen or loss of the Renter’s belongings during or upon vehicle return for servicing and maintenance. The Renter is advised to remove their valuable belongings such as laptop computer, gadgets, watches, sunglasses, notes, coins, touch & go, shoes, smart tag and others during vehicle returns for servicing and maintenance.









 

Fuel
The rental vehicle should be delivered with a full tank and returned by renter with a full tank. A refuelling surcharge will be levied for the rental vehicle returned with less fuel than when originally rented out, over and above the cost of refuelling. The same is applied to replacement vehicles. Please check with the Avis Representative on the charges upon pick up of vehicle.

Parking Fees & Traffic Fines

The renter is liable for all parking and traffic summonses incurred for the duration of the rental. An additional RM10.60 per summon administration fee (inclusive of 6% services tax) will be charged to the renter over and above any fine and penalty cost for any violation arising from renter's use of the vehicle. Avis retains the right to charge against the renter's charge/credit card, if and when any payment for traffic offences committed during rental is received, after the termination of rental.

Extension Of Rental

Should you wish to extend your rental beyond the original termination date, it is important that the renting station be advised immediately and the required advance payment paid so that insurance cover is extended. Failure to do so may mean the Renter is driving the vehicle without insurance. Any additional hour would be charged as 1 day full rental if the car is returned beyond the 3 hours grace period.

Delivery & Collection Service

Rental vehicles should be picked up and returned to Avis Malaysia’s station/office. Delivery will be made on request only and subject to charges. Delivery and collection charges within office hour vary according to distance and timing. Rates will be provided at the time of enquiry or confirmation of booking.

Upon return, the car has to be in the same condition as when it was rented. Failing which, the renter will be liable for the cost of restoring the vehicle to it's original condition. Please check the vehicle condition with Avis Representative during vehicle collection and ensure any visible dents / scratches are noted in the vehicle check list to avoid dispute.

Surcharge

A surcharge will be levied for check out and collection of vehicles after business hours, inclusive of Sundays and Public Holidays, for all locations nationwide. Service is On Request basis.

Surcharge for Late Arrival or After Hours Pick Up at KL, Kuantan and Johor Bahru office is RM106.00 (inclusive of 6% services tax).

Reservations with expected arrival time at the following locations would be charged at:

Penang airport:

2130 Hrs – 2359 Hrs: RM106.00 (inclusive of 6% services tax).

After 0000 Hrs: RM159.00 (inclusive of 6% services tax).

KL International Airport:

2200 Hrs – 2359 Hrs: RM106.00 (inclusive of 6% services tax).

After 0000 Hrs: RM159.00 (inclusive of 6% services tax).

Avis Fleet

Avis is unable to guarantee a specific make or model. Please note that bookings can only be made according to vehicle group and subject availability.

The rental vehicle is only insured for the person who makes the rental to be driving the vehicle. If there are other drivers who will be driving the car, they must be present at time of rental to be added to the Rental Agreement, subject to presenting a full driver's license that has been valid for at least one year. There is a fee for insurance coverage to cover each additional driver over the duration of the rental. The fee is RM10.60 per person  (inclusive of 6% services tax) per rental. All additional drivers have to be registered at time of rental and must meet Avis qualification criteria.

Additional Equipment

Child Safety Seat (2kg to 18kg) and GPS Navigation device is available upon request at the following additional cost:

Any faulty unit should be immediately informed to AVIS for a replacement unit. No refund would be given if feedback is only made upon return of vehicle. The following costs (inclusive of 6% goods & services tax) will apply in case of:

Preferred Card Profiles

If you indicate on your Wizard/Preferred profile that you will accept specific additional optional insurance coverages when you pick up your car, these will be processed at the time of rental and is not included in the quoted price unless indicated by the inclusions shown.

Entry Restriction

All Avis cars are not allowed to be driven into Labuan, Langkawi, Singapore, Thailand, Brunei and Indonesia.

One Way Rental

Should the vehicle be returned at a different city/location, one way rental cost would be applied. The cost is RM265.00 (inclusive of 6% services tax).
